What is an occupancy permit?
An occupancy permit specifies the conditions under which a building or space may be used. The permit focuses in particular on fire safety. With an occupancy permit, the municipality confirms that the building meets fire safety requirements and can be used safely for its intended purpose.
When is an occupancy permit required?
An occupancy permit is required for certain categories of buildings and spaces. It typically applies to buildings where large numbers of people can be present simultaneously, or where additional fire safety risks exist.
The following situations are at minimum covered:
- Hospitality venues such as restaurants, cafes, and hotels
- Buildings where more than 50 people can be present simultaneously
- Public buildings such as theatres, cinemas, sports halls, and event spaces
- Buildings with commercial childcare
- Buildings where people sleep, such as hotels and care facilities

How do you apply for an occupancy permit?
Applying for an occupancy permit is done through the Omgevingsloket Online. Follow these steps:
- Go to omgevingsloket.nl and log in with DigiD or eHerkenning.
- Click "Vergunning aanvragen" and select "Brandveilig gebruik" (fire-safe use).
- Complete the application form with all required information about the building and its intended use.
- Attach the required documents: floor plans of the building and a description of the fire safety measures.
- Submit the application and await the municipality's decision.
The municipality reviews the application and may request additional information. If the application is approved, you will receive the occupancy permit. If it is refused, you have the right to lodge an objection.
